Definitions

For the purposes of these Terms of Service & Membership Agreement, the following definitions apply:

"Agreement" or "Terms" means these Terms of Service & Membership Agreement, together with any documents incorporated by reference, including our Privacy Policy, Release of Liability & Assumption of Risk Agreement, Studio Policies, and any other policies made available by BurnHaus from time to time.

"Booking Platform" means the online software, website, mobile application, or third-party platform used by BurnHaus to manage accounts, memberships, reservations, payments, communications, and related services, including Mariana Tek by Xplor Technologies or any successor platform.

"BurnHaus," "we," "our," or "us" means BurnHaus Lagree Fitness Ltd., operating as BurnHaus Lagree Studio, together with its employees, instructors, contractors, agents, affiliates, successors, and permitted assigns.

"Member" means any individual who creates an account, purchases a membership or class package, books or attends a class, purchases products or services, or otherwise uses BurnHaus Services.

"Membership" means any recurring or fixed-term membership, introductory offer, promotional membership, founding membership, or other subscription-based product offered by BurnHaus.

"Services" means all products and services offered by BurnHaus, including but not limited to Lagree classes, personal training, wellness amenities, infrared sauna sessions, workshops, events, memberships, class packages, retail products, beverages, nutritional products, gift cards, website content, booking services, mobile applications, and any future products or services introduced by BurnHaus.

"Studio" means any BurnHaus Lagree Studio location now operating or opened in the future.

"Website" means the BurnHaus website and any associated online platforms operated by or on behalf of BurnHaus.

Welcome to BurnHaus Lagree

These Terms of Service & Membership Agreement ("Terms" or "Agreement") constitute a legally binding agreement between BurnHaus Lagree Fitness Ltd., operating as BurnHaus Lagree Studio ("BurnHaus", "we", "our", or "us") and you ("you" or "your").

These Terms govern your access to and use of BurnHaus's products and services, including, without limitation:

Our studio and facilities;
Lagree classes and private training sessions;
Infrared sauna and wellness amenities;
Workshops, community events, and special experiences;
Memberships, class packages, and retail purchases;
Our website;
Our booking platform and mobile applications; and
Any other products or services provided by BurnHaus (collectively, the "Services").

By creating an account, purchasing a membership or class package, booking or attending a class, using our website or booking platform, clicking "I Agree," "Accept," "Complete Purchase," "Reserve Class," or any similar confirmation, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

Your participation in BurnHaus Services is also subject to our:

Privacy Policy;
Release of Liability & Assumption of Risk Agreement;
Studio Policies; and
Any additional policies or guidelines made available to you from time to time.

These documents form part of your agreement with BurnHaus and should be read together. In the event of any inconsistency, these Terms will prevail unless otherwise required by applicable law.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you should not access or use BurnHaus's

Services.

At BurnHaus, we're committed to creating a welcoming, respectful, and inclusive environment where every member feels supported. In return, we ask that every member help us protect that experience by treating fellow members, instructors, staff, and our studio with care and respect.

Acceptance of These Terms

These Terms constitute a legally binding agreement between you and BurnHaus.

By creating an account, purchasing a membership or class package, booking or attending a class, purchasing products or services, using our Website or Booking Platform, clicking "I Agree," "Accept," "Complete Purchase," "Reserve Class," or any similar confirmation, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

Your use of BurnHaus Services is also subject to our Privacy Policy, Release of Liability & Assumption of Risk Agreement, Studio Policies, and any additional policies that may be published from time to time. Together, these documents form the complete agreement governing your relationship with BurnHaus.

If you do not agree with these Terms, you must not access or use BurnHaus Services.

Eligibility

BurnHaus is designed for individuals who are able to safely participate in Lagree fitness and wellness services.

To participate in classes or use our Services:

You must be at least 16 years of age.
Participants aged 16 or 17 must have a parent or legal guardian complete and sign the required Release of Liability & Assumption of Risk Agreement before participating in any class or using any BurnHaus amenities.
BurnHaus reserves the right to request proof of age at any time.
We reserve the right to refuse or suspend participation where we reasonably believe participation may present a safety risk to the participant, our team, or other members.

Participation in BurnHaus classes, wellness services, or events is always subject to completion of any required waivers and health acknowledgements.

Your BurnHaus Account

To purchase memberships, reserve classes, join a waitlist, purchase products, or access certain Services, you must create a BurnHaus account through our booking platform.

When creating your account, you agree to:

provide accurate, current, and complete information;
promptly update your information if it changes;
maintain the confidentiality of your login credentials;
accept responsibility for all activity that occurs under your account.

You are responsible for ensuring that your contact information, emergency contact information, and payment information remain current.

If you believe your account has been accessed without authorization, you must notify BurnHaus as soon as reasonably possible.

BurnHaus reserves the right to suspend or terminate accounts containing inaccurate, fraudulent, misleading, or incomplete information.

Accounts are personal to the registered member and may not be shared, transferred, sold, or used by another individual.

Our Services

BurnHaus offers a variety of fitness and wellness experiences, which may include:

Lagree classes
Introductory offers
Memberships
Class packages
Private training
Semi-private sessions
Infrared sauna sessions
Workshops
Community events
Retail merchandise
Nutritional products and beverages
Other wellness services introduced from time to time

Availability of Services may vary by location, schedule, instructor availability, maintenance requirements, or operational needs.

BurnHaus reserves the right to modify, discontinue, replace, or introduce Services at any time without prior notice.

Memberships & Purchases

BurnHaus offers a variety of memberships, class packages, introductory offers, wellness services, retail products, and special events designed to support your fitness journey.

Recurring Memberships
Class Packages
Introductory Offers
Drop-In Classes
Private and Semi-Private Training
Infrared Sauna Sessions
Workshops and Community Events
Retail Merchandise
Beverages and Wellness Products
Gift Cards

Availability may vary and BurnHaus reserves the right to introduce, modify, or discontinue products and services at any time.

Memberships

Membership details, pricing, billing frequency, commitment periods, and included benefits are displayed at the time of purchase and form part of your agreement with BurnHaus.

Unless otherwise stated, memberships are personal, non-transferable, and may only be used by the registered member.

Membership benefits, including booking windows, guest passes, discounts, and promotional offers, are subject to the specific membership purchased and may change from time to time.

Membership Commitment

Certain BurnHaus memberships are offered with a minimum commitment period. Where a minimum commitment applies, it will be clearly identified at the time of purchase and forms part of your Membership Agreement.

By purchasing a commitment-based membership, you agree to remain enrolled for the full commitment period. Memberships cannot be cancelled before the end of the applicable commitment period unless otherwise required by applicable law or approved by BurnHaus in writing.

At the conclusion of the minimum commitment period, your membership will automatically continue on a recurring month-to-month basis unless cancelled in accordance with these Terms.

Founding Memberships

Founding Memberships are limited-time promotional memberships available prior to the opening of BurnHaus or during designated promotional periods.

Founding rates and associated benefits apply only to the membership purchased and are subject to any commitment period selected at the time of purchase.

Founding Memberships cannot be transferred between individuals and may not be combined with any other promotional offer unless expressly stated.

Founding Memberships are subject to the payment, renewal, cancellation, and freeze provisions contained in these Terms unless expressly stated otherwise at the time of purchase.

Class Packages

Class packages are valid only for the number of classes and validity period specified at the time of purchase.

Unless otherwise stated:

Class packages are non-transferable.
Unused classes expire at the end of the applicable validity period.
Expired classes cannot be reinstated or refunded.

BurnHaus is unable to extend expired class packages except where required by law or approved by BurnHaus in exceptional circumstances.

Introductory Offers

Introductory offers are intended for new clients only and may be redeemed once per individual unless otherwise stated.

BurnHaus reserves the right to cancel or adjust introductory offers where duplicate accounts, misuse, or fraudulent activity is identified.

Gift Cards

Gift cards may be redeemed toward eligible BurnHaus products and services.

Gift cards are not redeemable for cash, are non-refundable, and may not be replaced if lost or stolen, except where required by applicable law.

Retail Products

Retail merchandise, beverages, supplements, and wellness products purchased through BurnHaus are subject to availability.

Unless required by applicable law, retail purchases are final sale.

If a product is defective or incorrect, please contact our team as soon as reasonably possible so we can assist you.

Payments

All prices are listed in Canadian dollars and are subject to applicable taxes.

By purchasing a membership, class package, retail product, or other BurnHaus service, you authorize BurnHaus and its third-party payment providers to charge your selected payment method for all applicable fees.

A valid payment method must remain on file for all active memberships.

You agree to:

maintain accurate billing information;
promptly update expired or replaced payment methods;
ensure sufficient funds are available when payments become due.

If payment cannot be processed, BurnHaus may:

retry the payment;
suspend booking privileges;
suspend access to memberships or services;
charge any applicable late or declined payment fees permitted by law.

Outstanding balances must be paid before additional bookings, purchases, or memberships may be accessed.

Automatic Renewals & Membership Cancellations

Recurring memberships automatically renew at the end of each billing cycle unless cancelled in accordance with these Terms.

By purchasing a recurring membership, you authorize BurnHaus to automatically charge your payment method on file for all applicable membership fees until your membership is cancelled.

If you wish to cancel your membership, you must provide BurnHaus with at least thirty (30) days' written notice prior to your next scheduled billing date. Cancellation requests must be submitted in writing to BurnHaus or through your BurnHaus account where available.

Memberships remain active, and all applicable membership fees will continue to be charged during the required notice period. Any scheduled payments that fall within the 30-day notice period remain payable.

Where your membership includes a minimum commitment period, you may submit your cancellation notice before the commitment period ends; however, your membership will remain active until both the minimum commitment period and the required thirty (30) day notice period have been satisfied.

Cancellation of your membership becomes effective at the end of the applicable notice period.

BurnHaus reserves the right to cancel or suspend memberships where permitted under these Terms or applicable law.

Membership Freezes

Eligible recurring memberships may be placed on hold for a minimum of two (2) weeks and a maximum of eight (8) weeks per calendar year.

Membership freezes are available only for active memberships that are in good standing, meaning the membership is current on all payments, is not subject to suspension, and is otherwise in compliance with these Terms.

Freeze requests must be submitted in writing before the requested freeze start date and are subject to BurnHaus approval.

Membership billing, renewal dates, and any applicable minimum commitment period will be extended by the length of the approved freeze.

Membership freezes are not available for class packages, introductory offers, promotional memberships, expired memberships, or memberships within a required minimum commitment period, unless otherwise approved by BurnHaus in writing.

BurnHaus may, at its sole discretion, approve additional freeze periods in exceptional circumstances, including medical reasons supported by a physician's note, pregnancy, or extended travel. BurnHaus reserves the right to request supporting documentation where appropriate.

BurnHaus reserves the right to charge a reasonable administrative fee for approved membership freezes where permitted by applicable law.

Pricing Changes

BurnHaus may update pricing for memberships, products, or services from time to time.

Where a pricing change affects an active recurring membership, reasonable advance notice will be provided before the new pricing takes effect.

Continued membership following the effective date of a pricing change constitutes acceptance of the updated pricing.

Booking Classes

Reservations may be made through BurnHaus's booking platform, website, or approved mobile application.

A valid membership, class credit, package, promotional offer, or other eligible booking credit is required to reserve a class.

Class availability is limited and reservations are accepted on a first-come, first-served basis.

BurnHaus reserves the right to modify class schedules, instructors, class formats, or studio locations at any time.

Instructors may be substituted without prior notice.

Booking windows vary by membership type and promotional offers and are subject to change from time to time.

BurnHaus reserves the right to cancel classes due to instructor illness, low attendance, maintenance, or other operational reasons.

Waitlists

If a class is full, you may choose to join the waitlist.

Should a space become available before the applicable booking cut-off, you may be automatically added to the class and notified using the contact information associated with your account.

By joining a waitlist, you acknowledge and accept that:

you are responsible for monitoring your bookings;
once you are automatically added to a class from the waitlist, the standard cancellation and no-show policies immediately apply;
if you no longer wish to attend, you must remove yourself from the waitlist or cancel your booking within the applicable cancellation window.

BurnHaus cannot guarantee placement from a waitlist.

Cancellations & No-Shows

To ensure fair access for all members, BurnHaus maintains a cancellation policy for all classes.

Classes may be cancelled without penalty up to 12 hours before the scheduled class start time.

Cancellations made within 12 hours of class start are considered late cancellations.

Late cancellations may result in:

forfeiture of the applicable class credit; and
a late cancellation fee charged to the payment method on file, as outlined in our current pricing and policies.

Failure to attend a reserved class without cancelling ("No-Show") may result in:

forfeiture of the class credit; and

a no-show fee charged to the payment method on file,as outlined in our current pricing and policies.

All cancellations must be completed through your BurnHaus account using our booking platform or mobile application.

BurnHaus cannot process cancellations submitted by email, social media, or voicemail.

These policies help ensure class availability and provide all members with fair access to our schedule.

The BurnHaus Experience

At BurnHaus, we're committed to creating an environment where every member can move with confidence, challenge themselves, and enjoy an exceptional studio experience.

To help maintain a safe, respectful, and welcoming space for everyone, we ask all members and guests to follow the policies below.

Studio Policies

Arriving for Class

We recommend arriving at least 10 minutes before your scheduled class to allow sufficient time to check in, prepare for class, and receive any necessary instruction.

First-time participants are required to arrive at least 15 minutes before class to receive an introduction to the Megaformer and studio procedures.

For safety reasons, BurnHaus reserves the right to refuse entry to participants who arrive after class has begun.

Grip Socks

Grip socks are required for all Lagree classes.

Members who arrive without grip socks may purchase a pair from the studio, subject to availability.

BurnHaus reserves the right to refuse participation to anyone not wearing appropriate footwear.

Personal Belongings

Lockers and storage areas are provided for your convenience.

Personal belongings should be stored before class begins to maintain a safe workout environment.

BurnHaus is not responsible for lost, stolen, or damaged personal property brought onto the premises.

Items left at the studio will be held for a limited period at BurnHaus's discretion. Unclaimed items may be donated, recycled, or disposed of after this period. BurnHaus is not responsible for lost, stolen, or abandoned property.

Mobile Devices

To preserve the experience for all members:

Mobile phones should be silenced before entering the studio.
Calls should be taken outside the workout space.
Photography or video recording during class is not permitted without prior approval from BurnHaus.

Food & Beverages

Only closed water bottles are permitted inside the workout studio unless otherwise authorized by BurnHaus.

Food should not be consumed during class.

Cleanliness

Members are expected to help maintain a clean and welcoming environment by:

wiping down equipment after use where requested;
returning studio equipment to its designated location;
disposing of waste appropriately; and
respecting shared spaces.

Infrared Sauna Policies

BurnHaus's infrared sauna is intended to complement your recovery experience.

By using the sauna, you acknowledge and agree that you do so voluntarily and at your own discretion.

Members using the sauna agree to:

follow all posted instructions and staff guidance;
remain hydrated before, during, and after use;
exit the sauna immediately if they feel dizzy, faint, unwell, or uncomfortable;
use the sauna only for the recommended session duration;
sit on a towel during each session;
wear appropriate attire while using the sauna.

For your safety, you should not use the sauna if you:

are under the influence of alcohol or drugs;
have a medical condition that makes heat exposure unsafe;
have been advised by a healthcare professional not to use heat therapy.

Members who are pregnant, recovering from illness, or have cardiovascular conditions or other medical concerns should consult their physician before using the sauna.

BurnHaus reserves the right to refuse or discontinue sauna access where it believes use may create a safety risk.

Health & Safety

Your health and safety are important to us.

By participating in BurnHaus Services, you acknowledge that you are responsible for determining whether you are medically able to participate in physical activity and wellness services.

You agree to:

participate within your own abilities;
immediately advise your instructor of any injury, medical condition, pregnancy, or limitation that may affect your participation;
stop exercising immediately if you experience pain, dizziness, shortness of breath, or feel unwell; and
follow all instructions provided by BurnHaus instructors and staff.

Completion of BurnHaus's Release of Liability & Assumption of Risk Agreement is required before participating in classes or using designated wellness amenities.

BurnHaus instructors are not medical professionals and any guidance provided during classes is intended solely for general fitness purposes.

Respecting Our Community

BurnHaus is built on respect, encouragement, and community.

We are committed to providing an inclusive environment where everyone feels welcome, supported, and safe.

We have zero tolerance for:

harassment;
discrimination;
bullying;
intimidation;
violence or threats of violence;
abusive, disruptive, or inappropriate behaviour;
damage to studio property; or
behaviour that compromises the safety or enjoyment of other members or our team.

BurnHaus reserves the right to suspend or permanently terminate memberships, remove individuals from the studio, or refuse future service where behaviour is inconsistent with these values.

Our goal is simple: create a space where everyone can show up, work hard, and leave feeling stronger than when they arrived.

Photography, Video & Media

BurnHaus may photograph, film, or otherwise record classes, workshops, community events, and other activities for promotional, educational, and marketing purposes.

By attending BurnHaus, you acknowledge that your image, voice, or likeness may appear in photographs or video recordings captured during these activities.

These materials may be used by BurnHaus in print or digital marketing, on our website, social media channels, email communications, advertising, or other promotional materials without compensation.

If you prefer not to appear in photographs or videos, please notify a member of our team before your class or event. BurnHaus will make reasonable efforts to accommodate your request; however, members acknowledge that photography and videography may occur during group classes and events where incidental appearances cannot always be avoided.

BurnHaus also utilizes security cameras throughout certain areas of the studio to help maintain the safety and security of our members, staff, and facilities.

Intellectual Property

All content made available by BurnHaus, including but not limited to:

the BurnHaus name;
logos;
branding;
website content;
graphics;
photographs;
videos;
written materials;
class programming;
instructor training materials;
digital content; and
other proprietary materials

are owned by or licensed to BurnHaus and are protected by applicable intellectual property laws.

Nothing contained in these Terms grants you any ownership or licence to use BurnHaus intellectual property except for your personal, non-commercial use of our Services.

You may not copy, reproduce, distribute, modify, publish, sell, record, livestream, or otherwise use BurnHaus content or branding without our prior written consent.

Members may not record classes for commercial purposes or reproduce BurnHaus programming without prior written consent.

Third-Party Services

BurnHaus partners with trusted third-party providers to deliver certain aspects of our Services, including booking, membership management, payment processing, email communications, analytics, and website hosting.

These providers may include platforms such as Mariana Tek by Xplor Technologies and other service providers selected by BurnHaus from time to time.

Your use of certain third-party services may also be subject to the terms, conditions, and privacy policies of those providers.

BurnHaus is not responsible for the availability, functionality, or privacy practices of third-party platforms beyond the services we directly provide.

Suspension & Termination

BurnHaus reserves the right to suspend, restrict, or terminate your account, membership, bookings, or access to our Services where reasonably necessary, including where:

payment remains outstanding;
fraudulent or unauthorized activity is suspected;
these Terms or other BurnHaus policies have been breached;
your behaviour places the safety, wellbeing, or enjoyment of others at risk;
you misuse BurnHaus facilities, equipment, or Services; or
continued access would be inappropriate or contrary to applicable law.

Where appropriate, BurnHaus may provide notice and an opportunity to resolve the issue before taking action.

Termination or suspension of access does not relieve you of any outstanding financial obligations owed to BurnHaus.

BurnHaus also reserves the right to refuse service where permitted by applicable law.

Privacy

Your personal information is collected, used, stored, and disclosed in accordance with our Privacy Policy.

By using BurnHaus Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

Our Privacy Policy forms part of these Terms and is available on our website.

Changes to These Terms

BurnHaus may update these Terms from time to time to reflect changes to our Services, operations, legal obligations, or business practices.

The most current version will always be available on our website and will include the revised "Last Updated" date.

Your continued use of BurnHaus Services following the effective date of any updates constitutes acceptance of the revised Terms.

If you do not agree to the updated Terms, you should discontinue use of our Services.

Force Majeure

BurnHaus shall not be liable for any delay, interruption, or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, public health emergencies, government actions, labour disputes, utility failures, internet or technology outages, fire, flood, or other unforeseen events. BurnHaus may temporarily suspend Services during such events without liability.

Where reasonably possible, BurnHaus will make commercially reasonable efforts to resume Services as soon as practicable.

Governing Law

These Terms are governed by and shall be interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

Any dispute arising from or relating to these Terms or your use of BurnHaus Services shall be subject to the exclusive jurisdiction of the courts of British Columbia, except where applicable consumer protection legislation provides otherwise.

Electronic Acceptance

You agree that your electronic acceptance of these Terms, including by creating an account, selecting a checkbox, booking a class, completing a purchase, or otherwise using BurnHaus Services, constitutes your legal signature and has the same force and effect as a handwritten signature.

Consumer Rights

Nothing in these Terms limits any rights you may have under applicable consumer protection legislation, including the Business Practices and Consumer Protection Act (British Columbia). Where required by law, those rights will prevail over these Terms.

General Provisions

These Terms constitute the entire agreement between you and BurnHaus regarding your use of our Services and supersede any prior discussions, understandings, or agreements relating to the same subject matter.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Failure by BurnHaus to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

These Terms are binding upon you and BurnHaus and shall benefit each party and their respective successors and permitted assigns.
